§ 1 Scope and Provider

These General Terms and Conditions apply to all orders placed by private individuals via the online shop of richhome shop, Hauptstraße 7, 33758 Schloß Holte-Stukenbrock, Business owner: Nelli Richert
(hereinafter referred to as "the Provider").

§ 2 Conclusion of Contract

§ 2.1 The product presentations in the online shop serve as an invitation to submit a purchase offer. By clicking the "Order now" button, you submit a binding purchase offer. Our products are sold exclusively for private use in household quantities.

§ 2.2 We can accept your order by sending an order confirmation via email or by delivering the goods within five days. The confirmation of receipt of the order does not yet constitute acceptance of the purchase offer.

§ 2.3 Should our order confirmation contain typing or printing errors, or should our pricing be based on technical transmission errors, we are entitled to challenge the contract, provided we can prove our error to you. Any payments already made will be reimbursed immediately.

§ 3 Prices

The prices stated on the product pages include the statutory value-added tax and other price components and do not include postage.

§ 4 Shipping Costs

§ 4.1 For deliveries within Germany, shipping is generally free for goods worth 50 Euros or more. If shipping costs are incurred, they will be explicitly stated.

§ 4.2 For cash on delivery payments, an additional fee of 6 EUR will be charged by the delivery person on site. No further taxes or costs apply.

§ 4.3 For returns of goods, richhome shop does not cover shipping costs, unless otherwise agreed in writing. Damaged goods are an exception.

§ 5 Delivery Conditions and Self-Supply Clause

§ 5.1 Delivery is made by a forwarding agent or by richhome's own vehicle.

§ 5.2 Delivery is made to the curbside, i.e., the forwarding agent is only responsible for delivery to the front of the house, but not for transport into your apartment/house. If you would like the goods delivered into your apartment/house, we offer the additional service of 2-person handling. For this, the request should be made in writing.

§ 5.3 Unless otherwise specified in the offer, the delivery time is approx. 1-3 weeks for packages and 1-6 weeks for furniture deliveries.

§ 5.4 Should not all ordered products be in stock, we are entitled to make partial deliveries at our expense, provided this is reasonable for you.

§ 5.5 Should the delivery of the goods fail despite three delivery attempts, we may withdraw from the contract. Any payments made will be reimbursed to you immediately.

§ 5.6 If the ordered product is not available because we are not supplied with this product by our suppliers through no fault of our own, we may withdraw from the contract. In this case, we will inform you immediately and, if applicable, suggest the delivery of a comparable product. If no comparable product is available or if you do not wish to receive a comparable product, we will immediately reimburse any consideration already provided.

§ 6 Payment Conditions

§ 6.1 Payment can be made optionally by prepayment, cash on delivery or Paypal.

§ 6.2 If you choose the payment method "prepayment", we will provide you with our bank details in the order confirmation. The invoice amount must be transferred to our account within 10 days. For payment by credit card, your account will be debited upon shipment of the goods.

§ 6.3 If you are in default of payment, the purchase price shall bear interest at a rate of 5% above the base interest rate during the period of default. We reserve the right to prove and claim higher damages caused by default.

§ 6.4 In the case of payment by direct debit, you may have to bear those costs that arise as a result of a chargeback of a payment transaction due to insufficient funds or due to incorrectly transmitted bank details by you.

§ 6.5 You are only entitled to a right of set-off if your counterclaims have been legally established by a court, are undisputed, or have been acknowledged by us in writing.

§ 6.6 You can only exercise a right of retention if the claims arise from the same contractual relationship.

§ 7 Retention of Title

The goods remain our property until full payment. Prior to the transfer of ownership, pledging, collateral assignment, processing, or alteration is not permitted without our consent.

§ 8 Right of Withdrawal

§ 8.1 Consumers have a two-week right of withdrawal.

§ 8.2 The right of withdrawal does not apply to the delivery of goods that are custom-made according to customer specifications or are clearly tailored to personal needs.

§ 8.3 Please avoid damage and contamination. Please return the goods, if possible, in their original packaging with all accessories and all packaging components. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage with suitable packaging to avoid claims for damages due to damage resulting from inadequate packaging.

§ 8.4 Please return the goods to us as an insured parcel and keep the proof of postage. Shipping costs will only be reimbursed if this has been agreed upon in writing with the owner of the goods.

§ 8.5 Please call us at Tel. no. 0049-(0)5205-915856 before returning to announce the return. This way you enable us to assign the products as quickly as possible.

§ 8.6 Please note that the modalities mentioned in paragraphs 8.3 to 8.5 are not a prerequisite for the effective exercise of the right of withdrawal.

§ 9 Transport Damages

§ 9.1 If goods are delivered with obvious transport damage, please report such defects immediately to the deliverer, and please contact us as soon as possible at .

§ 9.2 Failure to make a complaint or contact us has no consequences for your statutory warranty rights. However, you help us to assert our own claims against the carrier or transport insurance.

§ 10 Warranty

The warranty is provided in accordance with statutory provisions.

§ 11 Liability

We exclude our liability for slightly negligent breaches of duty, unless these concern essential contractual obligations, damages arising from injury to life, limb, or health, or guarantees, or claims under the Product Liability Act are affected. The same applies to breaches of duty by our vicarious agents.

§ 12 Final Provisions

§ 12.1 Should any provision of these General Terms and Conditions be invalid, the remainder of the contract shall remain valid. In place of the invalid provision, the relevant statutory provisions shall apply.

§ 12.2 The law of the Federal Republic of Germany shall apply, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If you placed the order as a consumer and at the time of your order had your usual residence in another country, the application of mandatory legal provisions of that country remains unaffected by the choice of law made in sentence 1.

§ 12.3 If you are a merchant and have your registered office in Germany at the time of the order, the exclusive place of jurisdiction is the seller's registered office, currently the District Court of Blomberg. In all other respects, the applicable statutory provisions for local and international jurisdiction apply.

The OS platform is intended to serve as a contact point for out-of-court resolution of disputes concerning contractual obligations arising from online sales contracts.
